Introduction
These terms and conditions govern your use of HakoBio online platform offering intuitive solution that enables a rapid configuration of bioprocesses and visualization of biomanufacturing units in 3D mode via the different tools made available on the platform (the Product Portfolio, the Solution Builder, the Personal Space, the Virtual Reality feature, etc) (collectively the “Platform”).
Please note that the online Platform is accessible on devices ( computer, laptop, tablets..) running only with Google Chrome or Firefox browsers ( last version).
By visiting or using this platform, you accept these terms and conditions in full. If you disagree with these terms and conditions or any parts of these terms and conditions, you must not use this platform.
Users of the Platform are provided with an user ID and password to access the Platform’s services.
Acceptable use
You must not use this website in any way that causes, or may cause, damage to the website or impairment of the availability or accessibility of the website; or in any way which is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity.
You must not use this website to copy, store, host, transmit, send, use, publish or distribute any material which consists of (or is linked to) any spyware, computer virus, Trojan horse, worm, keystroke logger, rootkit or other malicious computer software.

Proprietary rights and license to use the Platform
Unless otherwise stated, OUAT! and/or its licensors own the intellectual property rights in the Platform and material on the Platform. Subject to the license below, all these intellectual property rights are reserved.
Copyrights and any and all other intellectual property rights in all computer programs, documentation, reports and all other information developed, written and produced by OUAT! in connection with the Platform shall remain the exclusive intellectual property of OUAT!.
The information provided by any Customers or any other Content Providers in order to develop the platform or filled in by its representatives and its customers is confidential and shall not be used or divulged in any way.
By providing access to the Platform, OUAT! does not grant any tacit licenses to users concerning the elements and products used through the Platform and made available to it by Content Providers. These elements and products remain the property of the Content Providers unless otherwise expressly provided.
You may view, download for caching purpose only and print pages from the Platform for your own personal use, as well as share product information with your colleagues on social media or by email and save all configured processes and rooms in your personal space, subject to the restrictions set out below and elsewhere in the terms and conditions.
You must not:
- Republish/reproduce/reuse any material ( e.g. 3D files, other equipment ….) from the Platform (including republication/reproduction on another website) without OUAT! prior consent;
- Sell, rent or sub-license material from the Platform;
- Communicate any material from the Platform in public whitout OUAT! prior consent;
- Reproduce, duplicate, copy or otherwise exploit material on this Platform for a commercial purpose;
- Redistribute material from this website except for content specifically and expressly made available for redistribution;
Restricted access
OUAT! provides you with a user ID and password to enable you to access the full range of the services provided on the Platform, you must ensure that the user ID and password are kept confidential.
No warranties
The Platform is provided “as is” without any representations or warranties, express or implied. OUAT! makes no representations or warranties in relation to this platform or the information and materials provided on this platform.
Without prejudice to the generality of the foregoing paragraph, OUAT! does not in particular warrant that the simulated results generated by the Platform in relation to the processes and rooms that the user has designed by playing with the Platform, are representative of real life conditions.
Breaches of these terms and conditions
Without prejudice to OUAT!’s other rights under these terms and conditions, if you breach these terms and conditions in any way, OUAT ! may take such action as OUAT! deems appropriate to deal with the breach, including suspending your access to the Platform, prohibiting you from accessing the Platform, blocking computers using your IP address from accessing the Platform, contacting your internet service provider to request that they block your access to the Platform and/or bringing court proceedings against you.
Limitations of liability
OUAT ! will not be liable to you (whether under the law of contact, the law of torts or otherwise) in relation to the contents of, or use of, or otherwise in connection with, this website:
- for any direct, indirect, special or consequential loss; or
- for any business losses, loss of revenue, income, profits or anticipated savings, loss of contracts or business relationships, loss of reputation or goodwill, or loss or corruption of information or data.
These limitations of liability apply even if OUAT ! has been expressly advised of the potential loss.
Law and jurisdiction
These terms and conditions will be governed by and construed in accordance with Belgian Law, and any disputes relating to these terms and conditions will be subject to the exclusive jurisdiction of the French courts of Brussels.
Scope
This Privacy Policy applies to the HakoBio online platform at the address app.hakobio.com (the “Platform”) and any associated platforms at clientname.hakobio.com
There are two categories of users of the Platform: “Guest users” who can visit the Platform without logging in and providing personal information and “Professional users” who are provided with a user ID and password to access the full range of the Platform’s services.

When you register to the Platform, OUAT! may collect personal information i.e. information that may be used to identify or locate you, such as your name, postal address, e-mail address, phone number, as well as other non-public information that is associated with this personal information (“Personal Information”).
Use of Personal Information
OUAT! may use the Personal Information that you have knowingly provided to administer your account and provide you services, to send communications and administrative emails, to respond to your inquiries, to store your preference, and to send you commercial offers.
If you do not wish your Personal Information to be used in this way and do not agree with this privacy policy regarding Personal Information, you will not be able to access the Platform.

If you have provided Personal Information when registering to OUAT!’s Platform, you may access and modify that information at any time by visiting your personal space.
Security of your Personal Information
OUAT ! makes its best efforts to ensure the security of your Personal Information on its Platform and protect that information against unauthorized access to unauthorized alteration, disclosure or destruction. In particular, OUAT! uses Microsoft Azure trusted cloud computing services. These include managing and controlling identity and user access, encrypting communications, security networks as well as threat management and mitigation practices, including intrusion detection, denial-of-service (DDoS) and regular penetration testing.
International Users
The Platform is hosted in the EU. If you access the Platform from the USA, Asia, or any other region with laws or regulation governing personal data collection, use, and disclosure that differ from Belgian laws, please be advised that through your continued use of the Platform, you are transferring your Personal Information to Belgium and you consent to that transfer. Additionally, you understand that your Personal Information may be processed in countries (including Belgium) where laws regarding processing Personal Information may be less stringent than in your country.
